"Nr. Chairman, I informed Mr. Delaney before
I asked him to make a presentation that I was
not sure that the committee should be activated
at this time. I'm still not sure that it should
be right at this time. I think it would be best
for the staff to make recommendations and possi-
bly the Colorado River District to make their
recommendations and the Southeastern District,
on the actual creation of this because the oper-
ating principles themselves do not spell out
a number of details that should be spelled out."

"The next agenda item concerns the resolu-
tion which was also tabled at our last meeting.
This was submitted by Duane Barnard in connec-
tion with planning reports on the Parshall
participating project. I might state that a
status report has been published on this proj-
ect. The status report is for the purpose of
setting forth in report form all of the project
planning information available as of the date
of the report. Work was deferred on the final
phases of this project report pending resolution
of litigation involving project waters. The
District Court for the County of Grand has de-
termined that the ute Park Reservoir, as con-
ditionally decreed, is senior in priority to the
enlarged Williams Fork Reservoir, which decree
would firm up the project water supply. However,
the decision of the District Court has been
appealed to the Supreme Court of the State of
Colorado. Pending a decision by the Colorado
Supreme Court it would appear to me that the
legal questions concerning project water supply
have not yet been resolved and will not be
resolved until such time as the Supreme Court
renders its decision.
