"Well, I am sure that Mr. Delaney realizes,
as long as I have been presiding officer, the
fact that we ask for written resolutions has
been equally applied to everybody that appears
before this Board. I'm sure, when I say this,
that if the Board of Water commissioners of the
City and County of Denver came in on a day and
asked for different consideration in the ruling
that we have in effect, they would get the saml:l
treatment from the chair. Realizing that, I
feel that I'd like to see this Board postpone
any action on both the resolution and Mr. Delaney's
request at this time."

in this argument and also the Yampa River. I'd
like to ask the question if this is forming a
precedent? The Four Counties Ditch could readily
sell this to a municipality and thereby use the
Big Thompson Project to deliver their water. So
I would like to know if there is a precedent
being formed here on the Homestake Ditch which
could integrate our part of the country and
another transmountain diversion by using feder-
ally financed projects?"

respect to Mr. Nelson and Doc McCandless here,
that the request for a decree for the Four
Counties Ditch was rejected by the District Court
in Grand County and that no conditional decree
was given, so to that extent I don't think you
