Following Boa~d discussion. M~. Vandemoe~ moved. seconded .
by M~. Lochhead. that the Boa~d adopt the ~esolution as
~ecommended by the staff.

M~. Getches moved. seconded by Ms. Sanfilippo. that the
motion to adopt the ~esolution as ~ecommended by the staff be
amended to call fo~ the adoption of the ~esolution ~ecommended
by the staff with the addition of a new clause to ~ead:
"Whe~eas. Colo~ado pe~mits and encou~ages p~ivate wate~
development and financing of wate~ ~esou~ces th~ough
con5t~uction of facilities in Colo~ado. including p~ojects that
export water fo~ use in othe~ states. only if they comply with
state and fede~al law and inte~state compacts;" Motion failed
by a vote of 2 fo~ and 7 opposed.

The o~iginal motion was adopted by unanimous vote.

M~. Smith moved. seconded by M~. Vandemoe~. that the
Di~ecto~ send a lette~ to Gove~no~ Lamm. on behalf of the
Boa~d. exp~e5sing the Boa~d's suppo~t fo~ and concu~~ence in
the Gove~no~ls decision not to sign the option ag~eement which
had been offe~ed to him by the Galloway Group Limited for the
"lease" of Colo~ado wate~ to Galloway.

Motion adopted unanimously.

Added Aqenda Item - Water Riqhts Applications of Bar 70 .
Enterprises. Inc.. for Conditional Sto~aqe Decrees on the White
River

Atto~ney Gene~al Wooda~d advised that it would be p~oper
for the Board to go into executive session to discuss the
possibility of intervention by the Boa~d in the proceedings
conce~ning the wate~ ~ights applications filed by Ba~ 70
Enterprises. Inc.. in Water Division 5 on the White Rive~ (Case
No. 81CWS02 and 503).

Mr. Vandemoe~ moved, seconded by M~. Smith, that the Board
go into executive session to discuss with the Attorney General
the possibility of inte~vention in the above-mentioned case.
