SPARKS: -We've leaned over backwards to. try to.accemmedate'all <br />interests. We've said repeatedly that at anytime these filings appear <br />to interfere with any vested ~ights er any existing practices, whether <br />legal er not, that we're willing to accommedate our appropriatiens to. <br />recognize the practices that have been carried en in that particular. <br />stream. We'll go to any reasenable length to. preserve the existing <br />practiceson:any stream in this state that relates to the beneficial <br />use ef water. <br /> <br />I <br /> <br />Recently, a gentleman came in and said, "you,made a filing on a stream <br />in my area. . I've been diverting water up there fer thirty years and I <br />don't have a decree. 'Now, yeu've made a filing and you've jeopardized <br />my water rights." We teld that man to. make a filing and we would' <br />stipulate that his decree was senier to ours. In fact, he is senior to. <br />us, but he saept on his rights. We.told him:how te:correct his own . <br />negligence. We're willing to help people eut'all we can, except that <br />we do have to. know abeut it. <br /> <br />MR. FETCHER: As I get it, the thrust of your suggestien is that there. <br />be a preliminary list submitted to the board before it becemes final. <br /> <br />MR. SPARKS: Yes. <br /> <br />MR. FETCHER: But I'm net exactly sure how the suggestion that basically <br />John and Herb and I made that the Divisien of Wildli~e get input where <br />they believe there might be a conflict. <br /> <br />MR. SPARKS: This is what the preliminary list weuld be fer. We would <br />come to the beard, meeting with a preliminary list, to. discuss it, and <br />to determine if there are any potential areas of conflict, and to <br />determine the people that we sheuld meet with. Some way er anethet, <br />we've get to. have seme knewledgeef what to do in a,particu1ar area. <br />This would be the value of.the preliminary 1:ist. We would have several <br />months at least to. explore what group we should meet with, <br /> <br />MR. FETCHER: That might work, Larry. The enly thing 1'm saying is if <br />Duane Helton or Eddie in a particular area, say in Nerth Park where. <br />Chris is from, that there might be a~meeting even before the pre- <br />liminary list comes out. <br /> <br />MR. SHERMAN: It seems to me it's net only a question of dealing with <br />these specific recemmendatiens, but also. some of the cemments by the. <br />members ef the beard abeut the general precedure that has been used <br />by the Divisien of Wildlife and the staff ef the Water Censervation <br />Beard. I weuld urge the members, of this beard that if yeu have questiens <br />er ideas er comments about precedure, abeut the systematic way in which <br />they're trying to. come up with these recommendations, that you attempt <br />to. get together with these staffs and discuss them.
