The criteria used by staff for sorting each of the <br />segments into its respective Phase is as follows: <br /> <br />Phase 3 Streams: Include stream segments, w/lich are ready for the Public Review and Comment <br />and Board Action Phase. These instream flow segments have been reviewed by staff to ensure <br />each recommendation and data set is complete and standard methods and procedures have been <br />followed. In addition, staff has completed its map work and water availability studies. <br />As of January 1999, there are only 4 stream segments currently in Phase 3. These 4 stream <br />segments are located on Founnile Creek in Division 2 (see discussion below). <br /> <br />1998 was the first year that instream flow recommendations were processed under the new <br />procedures adopted by the Board as a result of Senate Bill 64 and substantial public comment. As <br />a result of the new Rules and Regulations and Procedures, the Board is being asked to resolve all <br />issues regarding the proposed instream flow recommendations prior to filing a water rights <br />application rather than in the water court process, as was the procedure in years past. This will <br />require additional up-front work in some cases. In addition to the additional field work and water <br />availability analysis that is now required, additional public notice has also been proposed. Staff <br />will work the Attorney General's Office (AGO) to revise the existing Rules and Regulations and <br />Instream Flow Procedures to allow for this change in operating procedures. Until the new <br />instream flow Rules and Regulations can be developed, staff does not anticipate filing any new <br />instream flow appropriations. Staff and the AGO plan to develop the new Rules and Regulations <br />in 1999. <br /> <br />. Phase 2 Streams: Include stream segments in which the CWCB staff has received an instream <br />flow recommendation and data set from an agency but has not yet completed its data review, map <br />work and water availability analysis. Staff is currently reviewing approximately 115 instream flow <br />recommendations and associated data sets to ensure standard methods and procedures have been <br />followed as well as determiriing if water iSllvailable for appropriation. (see Water Division <br />Discussions below). <br /> <br />Phase 1 Streams: Include stream segments in which a need for data collection has been identified <br />but no instream flow recommendation has been submitted to the CWCB staff. Field data mayor <br />may not have been collected at this time. Parties identifYing segments include the CWCB, <br />Colorado Division of Wildlife (CDOW), Colorado Division of Parks and Outdoor Recreation <br />(CDPOR), Bureau of Land Management (ELM), United States Forest Service (USFS) or <br />Interested Parties (IP). Approximately 577 additional segments have been identified for possible <br />instream flow consideration. Data on 60 of these stream segments has already been collected and <br />staffis anticipating instream flow recommendations will be submitted to the Board in 1999. <br /> <br />Future Instream Flow Appropriations <br /> <br />. <br /> <br />The following discussion will provide more detail as to the type of natural environment to be <br />protected, the proposed methodologies and anticipated work schedules. <br /> <br />5 <br />
