Wat. <br />bOn 8o:a <br /> <br />11/16/98 <br /> <br />Colorado Water Conservancy Board <br />1313 Sherman Street, Room 721 <br />Denver, CO 80203 <br /> <br />Dear Board Members, <br /> <br />The users of water on Four Mile Creek contend that there is <br />insufficient flow to meet the minimum stream flow recommended by <br />your staff. <br /> <br />We appreciate your staff attending our meeting held at the Roy <br />Canterbuty Ranch on November 9, 1998 and their explanation to us <br />of how they established the minimum flow figures. The method <br />employed to make these determinations was inadequate. We feel <br />the data gathered was insufficient for the following reasons. <br /> <br />1: Rain gauges outside of the drainage area were used to <br />determine rainfall measurements. <br />2. Flow records for only two of five ditches from the <br />confluence of Cripple Creek to the confluence of Wilson <br />Creek were used_ <br />3. Too short of a time period was used to make accurate <br />estimations. <br />4. There were also numerous contributing factors that were <br />not taken into account which may greatly affect <br />conditions in this large drainage area. <br /> <br />We are contending that from the confluence of Cripple Creek and <br />4-Mile Creek to the diversion point of the Adams-phillips Ditch <br />there are no other diversion points, which we feel would negate <br />the need for the minimum stream flow on this segment. We also <br />feel that from the Adams-Phillips Ditch downstream to Wilson <br />Creek the courts have already provided a minimum stream flow by <br />limiting the amount of water that can be transferred, based on <br />the Consumptive Use rules. <br /> <br />We have been told that the Bureau of Land Management requested <br />that a minimum flow be established on Four Mile Creek to maintain <br />a healthy environment for aquatic life_ This is inconsistent <br />with their classification of FourMile Creek as an intermittent <br />stream, however, a healthy environment for aquatic life has <br />existed and will continue to exist without an established minimum <br />stream flow_ <br />
