<br />I <br /> <br />I <br /> <br />Mr. Stapleton: Now you take the years '64 to '73, that is a pretty <br />short period of time. So we have no real assurance that that is a <br />realistic minimum or maximum, but we are only talking about minimum <br />stream flows. . <br /> <br />Mr. Sparks: We think it is representative. While we may only have a <br />particular gaging station in the ten years. we have other gaging stations <br />that have been in much lon~er so that we can interpolate the flow based <br />on other records. <br /> <br />Mr. Stapleton: What room for error in minimum stream flows does the <br />Division of Wildlife put into these things? Is this at the actual? <br />Once it drops down below that, do the fish die in the creek. or do they <br />have some margin of error? <br /> <br />Mr. Sparks: These studies are based upon spawning conditions. depth <br />of water in pools. the production of aquatic life which sustains fish <br />life and other factors. Then they come up with a figure that they <br />think is necessary to sustain fish populations. Obviously, we can't <br />guarantee that. and nature doesn't guarantee it either. So if the fish <br />die. they die and they are restocked. And this will happen. <br /> <br />Mr. Moses: <br />in some of <br />much lower <br />periods of <br /> <br />The other side of that coin is that fishing has survived <br />these streams with temporary flows. not long-term flows. <br />than some of these. Fish are fairly adaptable over short <br />time. <br /> <br />Mr. Stapleton: I think this board has the rQsponsibility not to file <br />minimum stream flows until we are sure that there are no current prob- <br />lems on the basis of the information we use. Because once we file <br />these, I think the public has some right to expect that the fish will <br />continue to exist. That is why I take it we are deferring some of the <br />streams today. <br /> <br />Mr. Moses: Not only that. I think the public has a right to expect us <br />to police any effort made by somebody in the future to reduce the <br />streem flow below the minimum. We just can't get these decrees in the <br />name of the water board and sit back and not be active in resisting any <br />future diversions that would bring the quality below the minimum. <br /> <br />Mr. s~arks: This is a staggering job for all concerned. We put together <br />a tas force consisting of representatives of the various state agencies <br />that are directly involved. That is. Parks and Outdoor Recreation and <br />the Division of Wildlife, together with the federal agencies. The <br />Forest Service. the BLM. and Bureau of Sport Fisheries and Wildlife are <br />the primary federal agencies concerned, along in some cases with the <br />Bureau of Reclamation. <br /> <br />This means that we will have several thousands of court cases in this <br />matter. Our attorney will be handling about fifty cases a year from <br />here on. We will request that his retainer be raised a little in the <br />future. We have already started policing it and that is the reason we <br />filed a protest in the case of the change of use on the Fryingpan <br />-where we already have decrees. <br /> <br />-36- <br />
