I <br />don't know whether they are going to give it to the board. but they will <br />give it to somebody. <br /> <br />Mr. Sparks: Well. I would think that they would have to give it to us <br />because we are the ones that have the decree. We would in turn have to <br />go in for a change of use in a court procedure and get it adjudicated <br />for this purpose. <br /> <br />Mr. Fetcher: That is the point I was trying to get. <br /> <br />Mr. Moses: The Boulder one is a little more complicated. It is not <br />rea~ly a good example. What we are going to get in Boulder are units <br />of Big T. which are stored in Boulder Reservoir. They will be used and <br />instead of Boulder using water out of Barker Reservoir. which is upstream <br />on Boulder Creek, they will release water out of Boulder Creek and <br />exchange it for the Big T water that is stored in Boulder Reservoir. <br /> <br />Mr. Fetcher: I gather that you will accept the gift. then. <br /> <br />Mr. Moses: I think that is the kind of thing that will be needed to <br />make the whole act effective. <br /> <br />Mr. Geissinger: I think that should be encouraged. <br /> <br />Mr. Sparks: Yes. I might point out that what these studies show on <br />these particular creeks is that the water is available for these mini- <br />mum stream flows today. <br /> <br />Mr. Geissinger: Right. <br /> <br />Mr. S1;>arks: Not only is the water there, but there is a lot more water I <br />than 1S necessary under present conditions. . We don't have any complaints <br />then until some future time somebody tries to pull it down below the <br />minimum. At the time we made our appropriation this water was available <br />and we are protected then to that extent. We will have cases where our <br />appropriation will be greater than the available water because of other <br />appropriations. There is nothing we can do about that, except what has <br />been suggested here. either purchase the water or somebody can donate <br />it to us to bring it up to that minimum flow. <br /> <br />-35- <br />
