<br />. <br /> <br />. <br /> <br />e <br /> <br />]3, Need fot Undcrstanding of Mexican Law and Programs <br />an understanding ofthc Mexican national govemmcnt's position on the restoration of the <br />delta and their rcstoration efforts to date, as wcll as an understanding of Mexican Law to <br />protect Colorado River water dedicated for such purposes <br />there is no clearly articulated restoration goal, including the extent of restoration that is <br />desired or feasible (land, watcr, species, etc,) <br />Delta-related issues are presently being litigated in United States District Court, where <br />some of the basin states and water uscrs have moved for intervenor status, Such litigation <br />will limit the scope of dialoguc conccrning the delta until that judicial process is <br />completed, <br />any mcaningful discussion of restoration efforts at the delta must also take into account <br />other Colorado River-related actions of mutual concern to Mexico and thc United States <br />(e,g, water and cnvironmental conservation planning cfforts in the U, S" deliveries to <br />Tijuana through the MWD system, Salton Sea restoration, delivery system coordination <br />between San Diego and Tijuana, impact of salinity issues at the SIB and operations of thc <br />Desalting Plant and replacement of future brine stream flows) <br />3, All water resource developmcnts on the Colorado River within the Unitcd States have been <br />consistent with and within the rights of the United States under the 1944 Mexican Treaty and <br />other clements of the "Law of the River," <br />4, Suggestions that additional water for restoration efforts at the Colorado River dclta should <br />come from reservoirs or sources with the United States are inconsistent both with the Mexican <br />Watcr Trcaty and other components ofthc Law of the Colorado River. Such suggestions <br />serve to thrcatcn thc longstanding vested rights of the basin states and their watcr users and <br />are therefore counterproductive in developing any constructivc dialogue between the United <br />States and Mexico regarding restoration of the Colorado River delta, <br />5, It is very important to distinguish any effort to restore the delta from the current process of <br />dcveloping interim operating criteria for Hoover Dam, Thc interim operating criteria arc not <br />ill any way intended for delta restoration purposcs, and any effort to impose delta rcstoration <br />goals onto thc interim operating criteria process will bc counterproductive, <br /> <br />2 <br />
