<br /> <br />required. A qualified registered civil engineer .must develop a rating curve. The <br />rating curve should be validated at least two flows using appropriate field <br />measuring techniques. . <br />. The total cost of materials, installation, maintenance and monitoring of the gaging <br />facility is the responsibility of the applicant. . <br /> <br />2. Liability <br />The CWCB shall assume no responsibility for use or misuse of the boating course and <br />will not accept liability for injuries or damages caused therefrom. The applicant (owner) <br />is expressly responsible for the operation, maintenance, and safety of the boating <br />course. CWCB approval or recommendation to endorse an applicant's proposed boating <br />course in no way implies that the CWCB accepts responsibility for final design, <br />construction, and operation of the boating course. <br /> <br />10. Interstate Compacts <br />The proposed RICD water right must (as required by Statute) be evaluated to <br />determine whether the RICD would impact the. State's compact entitlements. The <br />CWCB's Interstate Compacts section will review an RICD to ensure that the RICD does <br />not impair the ability of Colorado to fully develop and place to consumptive beneficial <br />use its compact entitlements. <br /> <br />11. Water Rights and Maximum Utilization of Waters of the State <br />The proposed RICD water right must (as required:by Statute) be evaluated to <br />determine whether the RICD would promote maximum utilization of Colorado's water <br />resources. To ensure that the RICD promotes maximum utilization of Colorado's water <br />resources, the Board and the applicant should include the following conditions if <br />appropriate: <br /> <br />. The RICD will not be in effect or exercised after 10 p.m. and before 6 a.m. <br />on any given day. <br /> <br />. The RICD will not be in effect during appropriately defined "drought <br />conditions" or "dry year conditions.". <br /> <br />. <br /> <br />. Any administrative call for the RICl:!> that will not provide for a reasonable <br />recreational experience will be pres~med futile. <br /> <br />. Any "call" by the Applicant for water to satisfy the RICD will only be <br />honored when a substantial number of persons are reasonably anticipated <br />to use the recreational boating coul1se, in order to prevent waste. <br /> <br />. <br /> <br /> <br />7 <br />
