<br />Any applicant to whom a variance is granted <br />will be given written notice that the <br />structure(s) will be permitted to be built <br />with a lowest floor elevation below the base <br />flood elevation, that premium rates for flood <br />insurance will increase significantly, and <br />that such construction below the base flood <br />elevation increases risk to life and <br />property. <br /> <br />4.3.4 Conditional variances <br /> <br />On consideration of the factors of Subsection <br />4.3.2 of these regulations, the Board of <br />Adjustment may attach such conditions to the <br />granting of variances, including a performance <br />guarantee, as it deems necessary to further the <br />purposes of the regulations. <br /> <br />4.3.5 Appeals <br /> <br />An applicant for a floodplain development permit <br />or any persons claiming to be affected by the <br />granting or denial of any such a permit may appeal <br />such granting or denial to the Board of Adjustment <br />by filing a notice of appeal with the Board of <br />Adjustment within thirty days of the granting or <br />denial of such permit. <br /> <br />An applicant or any persons claiming to be <br />affected by the decision of the Board of <br />Adjustment may appeal such decision for trial de <br />novo to the district court for the county in which <br />the decision was rendered by filing a notice of <br />appeal with said district court within thirty <br />days of the issuance of a final decision by the <br />Board of Adjustment. <br /> <br />4.4 Enforcement and Penalties <br /> <br />4.4.1 Ins ection and Documentation of Flood lain <br />BUl lng Constructlon an t e F 00 P aln <br />Development - The Admlnistrator is hereby <br />empowered and directed to inspect and examine the <br />use, occupation, or development of flOOdplains <br />subject to these regulations for the purpose of <br />determining from time to time whether any use, <br />occupation, development, or activity is in <br />violation or any of the provisions of this <br />regulation or any permit issued or required <br />pursuant to this or other applicable regulations. <br /> <br />-19- <br />
