Any applicant to whom a variance is granted
will be given written notice that the
structure(s) will be permitted to be built
with a lowest floor elevation below the base
flood elevation, that premium rates for flood
insurance will increase significantly, and
that such construction below the base flood
elevation increases risk to life and
property.

4.3.4 Conditional variances

On consideration of the factors of Subsection
4.3.2 of these regulations, the Board of
Adjustment may attach such conditions to the
granting of variances, including a performance
guarantee, as it deems necessary to further the
purposes of the regulations.

4.3.5 Appeals

An applicant for a floodplain development permit
or any persons claiming to be affected by the
granting or denial of any such a permit may appeal
such granting or denial to the Board of Adjustment
by filing a notice of appeal with the Board of
Adjustment within thirty days of the granting or
denial of such permit.

An applicant or any persons claiming to be
affected by the decision of the Board of
Adjustment may appeal such decision for trial de
novo to the district court for the county in which
the decision was rendered by filing a notice of
appeal with said district court within thirty
days of the issuance of a final decision by the
Board of Adjustment.

4.4 Enforcement and Penalties

Development - The Admlnistrator is hereby
empowered and directed to inspect and examine the
use, occupation, or development of flOOdplains
subject to these regulations for the purpose of
determining from time to time whether any use,
occupation, development, or activity is in
violation or any of the provisions of this
regulation or any permit issued or required
pursuant to this or other applicable regulations.
