WHEREAS, Public Law 92-514, as amended by Public Law 96-375,
authorizes the Secretary of the Interior to construct, operate,
and maintain the Closed Basin Division, San Luis Valley Project,
Colorado, hereinafter referred to as the "project"1 and

WHEREAS, Sec. 102(a) of said pUblic law requires that there
be positive identification of any fluctuations in the water table
of the area surrounding the Project attributable to operation of
the Project or any part thereof 1 and

WHEREAS, the Bureau of Reclamation must drill certain
exploratory aquifer testing and observation wells in Stages 3, 4,
and 5 of the Project in order to identify the confining layer and
to facilitate the accomplishment of Sec. 102(a).

NOW THEREFORE, BE IT RESOLVED that so long as the Project
proceeds in substantial conformity with the Definite Plan Report
for said Project and with the most recently developed, mitigation
plan therefor, and so long as the United States proceeds with
diligence in the construction of the Project, the Colorado Water
Conservation Board does not object to the BUreau of Reclamation
drilling such exploratory aquifer testing and observation wells
in Stages 3, 4, and 5 of the Project1 and

BE IT FURTHER RESOLVED that the Colorado Water Conservat ion
Board is not, by this action giving its consent to the Bureau of
Reclamation to start construction in Stages 3, 4, or 5 of the
Project.

I certify that the foregoing is a true and correct copy of a
resolution adopted by a majority vote of the members of the
Colorado Water Conservation Board in regular session assembled at
Denver, Colorado, on the 1st day of April 1982, at which a quorum
was present.
