Subject to the "General Criteria for Ruedi Releases. presented by the Service at the public <br /> <br />meeting held on June 2S, 1998, in Glenwood Springs, Colorado, and existing obligations of <br /> <br />Reclamation for releases from Ruedi Reservoir, Reclamation will make a reasonable effort to <br /> <br />operate Ruedi Reservoir to have a minimum storage of 9S,OOO acre-feet on September I, 1998, <br /> <br />and 8S,000 acre-feet on October 1, 1998, and to limit the maximum release to 2S0 as. Provided, <br /> <br />however, the operation ofRuedi Reservoir to meet these storage amounts and limiting the <br /> <br />maximum release pursuant to this MOA shall not be precedent nor bind Reclamation to this <br /> <br />operation ofRuedi Reservoir beyond the scope and term of this MOA <br /> <br />. <br /> <br />8. ENVIR.ONMENT AL COMPLIANCE <br /> <br />The Environmental Compliance for performance under this MOA is pursuant to EIS-88-1 0, <br /> <br />FSES-89-19, and Categorical Exclusion Checklist No. ECAO-98-22. . <br /> <br />. <br /> <br />9. ENFORCEMENT <br /> <br />a. The B~ard will take such &ction under state law, including requesting administration by the <br /> <br /> <br />State Engineer and the Division Engineer for Water Division S and initiating water court <br /> <br /> <br />proceedings, as may be necessary to obtain delive~ of the water from the outlet works of the dam <br /> <br /> <br />from which the water is released to the beginning of the IS-mile reach and to protect the release <br /> <br />12 - <br /> <br />. <br /> <br />( <br />
