85,000 acre-feet on October 1, 2000, and to limit the maximum release to 250 cfs. Provided,
however, the operation of Ruedi Reservoir to meet th~se storage amounts and limiting the
maximum release pursuant to this MOA shall not be precedent nor bind Reclamation to this
operation of Ruedi Reservoir beyond the scope and term of this MOA.

8. ENVIRONMENTAL .COMPLIANCE

The Environmental Compliance for performance under this MOA is pursuant to EIS-88-1 0,
FSES-89-19, and Categorical Exclusion Checklist No. ECAO- 01-34.

9. ENFOkCE)\1ENT

a. The Board will take such action under state law, including requesting administration by the e
State Engineer's Office and initiating water court proceedings, as may be necessary to obtain
delivery of the water from the outlet works of the dam from which the water is released to the

beginning of the 15-Mile Reach and to protect the r~lease from diversion by third parties within

the 15.Mile Reach, subject to such transit losses as may be imposed by the State Engineer or the

Division Engineer for Water Division 5. Reclarnatililn will cooperate with the Board to protect

the water released from the outlet works of the <lam from which the water is being released

through, and to the downstream terminus of the 15~Mile Reach.

b. The terms and conditions of this MOA shall be enforceable by any party to this agreement in
a court of competent jurisdiction; Provided, however, that before commencing an action for
enforcement of this contract, the party alleging viol!ttion shall notify the other parties in writing
of the alleged violation, and the parties shall make ~ good faith effort to resolve their differences
through informal discussions.
