<br />-- <br /> <br />e c. The Service and the Board will use the water released under this MOA only for the purposes <br />specified in Articles 6.a. and 6.b. above herein. No lease, sale, donation, or other disposal of any <br />dfthe water provided pursuant to this MOA will be permitted. The Service and the Board shall <br />not compromise, subjugate, or encumber the water released in any manner whatsoever. <br /> <br />d. Reclamation, the Service, and the Board agree that the Grand Valley Water Users Association <br />and Orchard Mesa Irrigation District may divert the water through the headgate of the <br />Government Highline Canal of the Grand Valley Project and may use that water for generation of <br />power at the Grand Valley Powerplant of the Grand Valley Project, so long as that water is <br />returned to the Colorado River either over the Grand Valley Irrigation Company's diversion dam <br />or under the radial gates at the check structure below the Grand Valley Powerplant. <br /> <br />. <br /> <br />7. RIGHTS RESERVED <br /> <br />a. Reclamation reserves the right to supply the water from water which has been lawfully stored <br />in priority in storage reservoirs other than Ruedi Reservoir; Provided, however, that releases <br />from alternate storage reserVoirs shall be in conformity with the water rights decrees for such <br />reservoirs and shall comply with state law. When supplied from an alternate reservoir, the water <br />shall be delivered by Reclamation from the outlet works of such alternate reservoir, and shall be <br />limited by the capacity of such outlet works. This water shall be measured at such outlet works <br />by the Contracting Officer with equipment furnished, operated, and maintained by Reclamation <br />at its expense. <br /> <br /> <br />. <br /> <br />b. Subject to the "General Criteria for Ruedi Releases" presented by the Service at the public <br />meeting held in May 2000, in Basalt, Colorado, and existing obligations of Reclamation for <br />releases from Ruedi Reservoir, Reclamation will make a reasonable effort to operate Ruedi <br />Reservoir to have a minimum storage of95,000 acre-feet on September 1,2000, and <br /> <br />10 <br /> <br /> <br />- <br />
