MR. STAPLETON:

"We'll call the meeting to order. We
will turn to Agenda Item #4 'consideration
of Animas-La plata Project Compact'. Larry."

MR. SPARKS:

"This agenda item also is a proposal to
amend H. R. 4671. The bill, as approved by
the Interior and Insular Affairs Committee
last year, had a provision in it that the
Animas-La plata Project could not be con-
structed until the States of Colorado and
New Mexico had entered into an agreement
concerning that project. I have sent the
Board a memorandum explaining the difficulty
we have had with New Mexico concerning the
Animas-La plata project.

The Upper Colorado River Basin Compact
in Article IX contains a rather peculiar
statement to the effect that the rights
granted to other states will be subject to
the rights of water users in Colorado in
which said reservoirs or works are constructed.
This secticn refers to the reservoirs or works
constructed in Colorado for the benefit of
ot.h:Jr s"cates. This section has worried New
E"xico. It has thought that if the Animas-
La Plat~ project were constructed that per-
h2ps this particular sentence of the Upper
ColoraGo River Basin compact could be used

take away the water right it might have for
the Animas-La Plata project.
