W-3637 and <br />86CW221. <br /> <br />The District may only operate the plan for exchange to the structures set forth in <br />paragraphs 4(i), 4(j) and 4(k) when the flow of Gore Creek immediately below the point of <br />diversion ofthat structure to which water is being exchanged equals or exceeds the instream flow <br />decreed to the Colorado Water Conservation Board in Water Court Case Nos. W-3636 and <br />86CW222. <br /> <br />So as to assure the operation of the subject augmentation and exchange plan, pursuant to <br />... 37-92-502(5), the District will install, monitor, and maintain such water measuring devices <br />and implement such accounting procedures as may be require by the Division Engineer to verifY <br />that the amount of augmentation water equals the amount of consumptive use resulting from the <br />out-of-priority diversions augmented herein and otherwise administer the terms of this decree. <br /> <br />(4) Case No. 5-98CW205; Upper Eagle Regional Water Authority <br /> <br />The Board ratified the Statement of Opposition filed in this case at its March 29-30,1999, <br />meeting. This is an application for approval of plan for augmentation and exchange on the Eagle <br />River near the town of Avon in Eagle County.
