Applicant proposes to augment up to 1100 consumptive acre- <br />feet of out -of-priority depletions at the Beaver Creek Snowmaking Pipeline and the alternate <br />points of diversion for the Vail Mountain Snowmaking Pipeline with releases of water from <br />Eagle Park Reservoir and the Arkansas Well. <br /> <br />The Board holds the following instream flow water rights that may be injured by this <br />application: <br /> <br />.,,~ <br /> <br />Case No. <br />5-78W3796 <br />5-80CW134 <br />5-80CW126 <br />5-80CW124 <br /> <br />Stream <br />Eagle River <br />Eagle River <br />Eagle River <br />Eagle River <br /> <br />Amount (cfs) <br />50/20 <br />85/35 <br />110/45 <br />130/50 <br /> <br />Appropriation Date <br />5/12/78 <br />3/17/80 <br />3/17/80 <br />3/17/80 <br /> <br />Stipulations <br /> <br />Applicant has agreed to the following terms and conditions that will provide full <br />protection for the Board's instream flow water rights on the Eagle River. <br /> <br />When the flow of the Eagle River immediately downstream of the point of diversion of <br />the diverting structures described in Paragraph 4 is less than the instream flow decreed to the <br />Colorado Water Conservation Board in Case No. 80CW134, then the Applicant must fully <br />replace all of its snowmaking diversions and domestic depletions resulting from diversion at such <br />structures made pursuant to this plan for augmentation; provided, however, to the extent that the <br />return flows from any domestic diversions at such structures made pursuant to this plan for e <br />augmentation do not return at or upstream of such diverting structures, then the corresponding <br />domestic diversion must be fully replaced pursuant to this plan for augmentation. <br /> <br />So as to assure the operation of the subject augmentation plan, pursuant to"" 37-92- <br />502(5), Vail will install, monitor, and maintain such water measuring devices and implement <br />such accounting procedures as may be require by the Division Engineer to verify that the amount <br />of augmentation water equals the amount of consumptive use resulting from the out-of-priority <br />diversions augmented herein and otherwise administer the terms of this decree. <br /> <br />(3) Case No. 5-98CW204; Eagle River Water & Sanitation District <br /> <br />The Board ratified the Statement of Opposition filed in this case at its March 29-30, 1999, <br />meeting. This is an application for approval of plan for augmentation and exchange on the Eagle <br />River near the town of Vail in Eagle County.
