In addition, an Environmental Assessment was drafted <br />to address the impacts that may be associated with the proposed title transfer and to facilitate <br />compliance with the NEP A, the Endangered Species Act (ESA) and the National Historic <br />Preservation Act. Copies of this document were provided to the Fish and Wildlife Service, the <br />National Marine Fisheries Service and an environmental group (the Natural Resources Defense <br />COUllcii -- which had expressed interest in Reclamation's title transfer activities), The next stcp is <br />to adopt this legislation which will authorize the implementation of the Agreement, <br /> <br />. <br /> <br />. Aireement: The Agreement, that was negotiated, when authorized by Congress and signed by the <br />Secretary, or his designee, would convey by quitclaim deed, all right, title and interest in the <br />Oriszinal Distribution Svstem and control tank to the District, The remainder of the District's <br />repayment obligation WIll be considered as saUs1led. The Ulstrlct Will contlnue to nOlo a water <br />service contract consistent with Reclamation law and policy and with CVP rate setting laws and <br />policies. The District \\oill assume all rights and responsibilities for operations, maintenance and <br />replacement and will agree to indemnify and hold the United States harmless for all claims <br />relating to any future acts involving the original distribution system, for all claims involving <br />. installation of the system and for prior billing and repayment relative to the system.
