<br />; <br /> <br />- <br /> <br />. <br /> <br />. <br /> <br />ATTACHMENT AGENDA ITEM 3 <br /> <br />RESOLUTION FROM THE COLORADO WATER CONSERVATION BOARD TO THE <br />U,S. BUREAU OF RECLAMATION CONCERNING THE PROPOSED <br />RULES AND REGULATIONS/GUIDELINES <br /> <br />WHEREAS: The U.S. Bureau of Reclamation has proposed rules and regulations <br />concerning the Reclamation Reform Act of 1982 which will impose undue <br />hardship on all of Colorado's water users and jeopardizes Colorado's prior <br />appropriation system, and <br /> <br />WHEREAS: The proposed rules and regulations do not allow adequate flexibility to <br />customize or to adjust plans to reflect Colorado's hydrological systems, and <br /> <br />WHEREAS: The "adoption of conservation plans" by the Bureau of Reclamation <br />signifies a federal action that would trigger NEPA, Section 7, Endangered <br />Species Act, and Historical Preservation Act compliance which would <br />result in a Bureau-wide Environmental Impact Statement and would be an <br />considered M unfunded mandate, and <br /> <br />WHEREAS: Colorado believes that water conservation measures must consider impacts <br />to all vested water rights and water users within the State, and <br /> <br />WHEREAS: Colorado believes water conservation measures must recognize the various <br />beneficial uses to which water is applied, and <br /> <br />WHEREAS: Colorado Water Law Provides adequate guidance for efficient and <br />beneficial use of our Water Resources, and <br /> <br />WHEREAS: Colorado supports the wise use of water, and has developed a conservation <br />program under the direction the CWCB which recognizes the various <br />beneficial uses to which water is applied, and <br /> <br />WHEREAS: The State of Colorado and the Water Users are responsible to manage <br />Colorado Water Resources, and not the Federal Government, <br /> <br />IT IS NOW THEREFORE RESOLVED: <br /> <br />That the Colorado Water Conservation Board is opposed to implementation <br />of the water conservation guidelines/Rules and Regulations by the U.S. <br />Bureau of Reclamation because they do not adequate!y consider the <br />environmental, climatic, hydrologic and economic conditions affecting <br />water use in Colorado, are adverse to state law, and place undue financial <br />burdens on Colorado's water users. <br />
