RULE OF CONSTRUCTION <br /> <br />2 <br /> <br />Nothing in this Act shall be construed to-- <br /> <br />3 <br /> <br />(1) authorize, expressly or by implication, the <br /> <br />4 <br /> <br />appropriation or reservation of water by any Federal agency, or <br /> <br />5 <br /> <br />any other entity or individual other than the State of Colora~o, <br /> <br />6 <br /> <br />for any instream flow purpose associated with the Area; <br /> <br />7 <br /> <br />(2) affect the rights or jurisdiction of the United <br /> <br />8 <br /> <br />States, a State, or any other entity over waters of any river or <br /> <br />9 <br /> <br />stream or over any ground water resource; <br /> <br />e <br /> <br />(3) alter, amend, repeal, interpret, modifY, or be in <br /> <br />11 <br /> <br />conflict with the Compact; <br /> <br />12 <br /> <br />(4) alter or establish the respective rights of any State, <br /> <br />13 <br /> <br />the United States, or any person with respect to any water or <br /> <br />14 <br /> <br />water-related right; <br /> <br />15 <br /> <br />(5) impede the maintenance of the free-flowing nature <br /> <br />16 <br /> <br />of the waters in the Area so as to protect-- <br /> <br />17 <br /> <br />(A) the ability of the State of Colorado to fulfill its <br /> <br />18 <br /> <br />obligations under the Compact; or <br /> <br />e <br /> <br />(B) the riparian habitat within the Area. <br /> <br />DRAFT.
