I

I

not take away any policy making powers other-
wise given to an agency by statute'. No one
has adequately defined, so far as I am concerned,
what that means yet but the statute should be
kept in mind by the Board."

MR. STAPLETON:

"Well, I'm not sure where that gets us. We
need a Philadelphia lawyer now to straighten us
all out."

MR. SARGENT: "May I ask a question, Mr. Stapleton?"

MR. STAPLETON: "Yes, Mr. Sargent."

MR. SARGENT: "I'd like to ask either Mr. Moses or Mr.
Barnard whether or not the state statute, which
they cited which creates the Upper Colorado
River Commission, is different in language than
the Act of Congress which created the Upper
Colorado River commission and approved the Upper
Colorado River Compact which is Public Law 37,
passed by Congress April 6, 1949, 63 Statutes
131?1I

MR. BARNARD, JR.: "I've not read that particular section of
the Compact. Of course, it's the same whether
it's printed in our statutes or in the federal
statutes. The appointment of the Commissioner
is provided by state statute. It is not part
of the Compact. In other words, this statute
is a part of the same statute which ratifies
the Compact as far as Colorado is concerned.
Although I'll confess that I have not read the
federal statute approving the Compact."

MR. SARGENT: "I wonder if it would be possible for us to
get a copy' of 63 Statutes '31 for this meeting?"

MR. BARNARD, JR.: "We don't have it in our office. We would
have to get it out of the Supreme Court library
and that might take an Act of Congress."

MR. STAPLETON:

"I think we can get it. We may be here for
a while at least. lfuat is the citation?"

MR. SARGENT:

"63 Statutes '31."
