I would be willing to consider an adjustment of our wheeling charges after the initial fifty- year period. He also asked if we would be willing to see if we could obtain similar assur- ances from the other companies. We simply re- sponded to that request and after studies and discussion we did assure the Upper Colorado,River Commission that we would be willing to enter into bona fide wheeling contracts whereby we would be willing to adjust our wheeling charges after the initial fifty-year period or after the amortization of the investment in our own trans- mission facilities associated with wheeling, whichever is earlier, to reflect simply ad valorem taxes and operation, maintenance and replacement costs thereafter'. After we had given that assurance to the Commission, we now find ourselves in the posi- tion of where we have attempted to make an assurance at the request of the Upper Colorado River Commission and we are now in the mess we are in today. I can assure you that there was never any attempt or any thought on the part of our company to ignore the Colorado Water Board. We were simply responding to a request made to us by the Upper Colorado River Commis- sion. I I might say this, though, in fairness to your understanding of our situation. I per- sonally did not consider Mr. Sparks' summary to this Board of the facts at your August 2nd meeting objective. I was not satisfied that we would really accomplish anything by dis- cussing this matter with Mr. Sparks. I do want to assure this Board that the communica- tions between our engineers and this engineer- ing staff, Mr. Kuiper, Mr. McClellan and Mr. FiSk; have continued. As a matter of fact, there was a meeting of that group with officials of our company the very day the Upper Colorado River Commission was meeting and I hope that these types of contacts will continue. I would like to say this, that we regret very much the situation we find ourselves in
