<br />I <br /> <br />would be willing to consider an adjustment of <br />our wheeling charges after the initial fifty- <br />year period. He also asked if we would be <br />willing to see if we could obtain similar assur- <br />ances from the other companies. We simply re- <br />sponded to that request and after studies and <br />discussion we did assure the Upper Colorado,River <br />Commission that we would be willing to enter <br />into bona fide wheeling contracts whereby we <br />would be willing to adjust our wheeling charges <br />after the initial fifty-year period or after the <br />amortization of the investment in our own trans- <br />mission facilities associated with wheeling, <br />whichever is earlier, to reflect simply ad <br />valorem taxes and operation, maintenance and <br />replacement costs thereafter'. <br /> <br />After we had given that assurance to the <br />Commission, we now find ourselves in the posi- <br />tion of where we have attempted to make an <br />assurance at the request of the Upper Colorado <br />River Commission and we are now in the mess we <br />are in today. I can assure you that there was <br />never any attempt or any thought on the part <br />of our company to ignore the Colorado Water <br />Board. We were simply responding to a request <br />made to us by the Upper Colorado River Commis- <br />sion. <br /> <br />I <br /> <br />I might say this, though, in fairness to <br />your understanding of our situation. I per- <br />sonally did not consider Mr. Sparks' summary <br />to this Board of the facts at your August 2nd <br />meeting objective. I was not satisfied that <br />we would really accomplish anything by dis- <br />cussing this matter with Mr. Sparks. I do <br />want to assure this Board that the communica- <br />tions between our engineers and this engineer- <br />ing staff, Mr. Kuiper, Mr. McClellan and Mr. <br />FiSk; have continued. As a matter of fact, <br />there was a meeting of that group with officials <br />of our company the very day the Upper Colorado <br />River Commission was meeting and I hope that <br />these types of contacts will continue. <br /> <br />I would like to say this, that we regret <br />very much the situation we find ourselves in <br />
