Lower Arkansas Commission 11:04 - 11:42 a.m. <br />Tape 1, Start/Stop 2237 - 3800 <br />Tape 2, Start/Stop 385 - 1032 <br />Action: A motion was made by David Harrison to ask the staff representative <br />to LAR.C to convey to them the Board's concerns regarding this one <br />issue, in a context that doesn't reflect opposition to the overall plan, <br />but really expresses the Board's concern that there not be any <br />interference with the compact, and that they include in the plan a <br />condition that any transaction be expressly conditioned in a way which <br />is enforceable upon there being no enlargement of the use of water, <br />. and there be no interference with the compact, and in that respect, <br />enlargement of the use means no material change in the return flow <br />patterns. And in addition, that the Board ask the other agencies to <br />have the ultimate transaction sent to the State Engineer for review as <br />to its enforceability. The motion was seconded by Leo Eisel, and was <br />passed unanimously (9-0). <br /> <br />5b. The motion was seconded by Jim Lochhead, and the <br />motion passed unanimously (9-0). <br /> <br />7. Public Comment on Matters in Executive Session 12:30 - 12:33 p.m. <br />Tape 2, Start/Stop 321 - 370 <br />Action: No public comment was given. Jennifer Gimbel reported that it was <br />appropriate for the Board to go into Executive Session. The. Board <br />voted unanimously (9-0) to go into Executive Session. <br />8. Executive Session 12;45 - 2:30 p.m. <br />The A WW v. CWCB (Snowmass Creek) case, Reserved Rights case, and Animas-La <br />Plata litigation were discussed.
