BARNARD, SR.: "It's in there': the rate is in there, <br />but I am advised by Mr. Millen, I think it <br />is, of .the Public Service Company - I assumed <br />that the Secretary had established a rate I <br />for firm power and a rate for secondary <br />power - but he tells me that the secondary <br />power is established by'a formula which in <br />turn is based upon the rate for firm power. <br />How that works out, I don't know and I am <br />not qualified to find out. You would have <br />to be an electrical engineer to figure that <br />out. <br /> <br />Now the Investigation Commission in <br />advance of this meeting suggested to Mr. <br />Sparks that the man designated to do this <br />work be Mr. McClellan. Mr. Sparks has in- <br />dicated that that can be arranged. However, <br />that study must be done, not by an engineer <br />alone, but by an engineer and a lawyer who <br />will have to work together. Now if it is <br />the desire of the Director and the Board, I <br />certainly will work with Mr. McClellan in <br />making that study because I know what things <br />I want to find out, but I don't know how to <br />find them out. <br /> <br />That's the second thing that must be <br />done. Then the third thing - I have tried <br />to find and haven't found them yet - what <br />I was going to say there was that, in con- <br />sidering legislation, any legislation, it <br />is very helpful to know what the background <br />of that legislation was. What were the rea- <br />sons for its adoption, what considerations <br />entered into the language in which it was <br />couched and arranged? I haven't found any <br />legislative history of the Boulder Canyon <br />Project Adjustment Act. I think perhaps <br />it is in the library in the Water Board and <br />we are going to search for that this after- <br />noon, Mr. Sparks and I. That must be re- I <br />viewed and abstracted. I will say that I <br />have abstracted the legislative history of <br />the Swing-Johnson Bill, the Boulder Canyon <br />Project Act. I was able to get that in- <br />formation and abstract it and have that . <br />separate from this report. <br /> <br />That must be done.
