<br />1298 <br /> <br />I am going to point out four things which <br />must be done as rapidly as they can be <br />done, and as this work progresses it will <br />provide our officials with more informa- <br />tion on which to base their contentions <br />and arguments, and what have you, in these <br />conferences before Congress. <br /> <br />The case of Arizona vs. California is <br />the first that comes to mind. It is now of <br />no consequence and perhaps the Board isn't <br />interested in the fact that at the time that <br />case was filed, I still believe that Colo- <br />rado should have played a part in it, possi- <br />bly as a party, but at least as an observer, <br />finding out what was going on because things <br />happened in that case that are going to have <br />a bearing on our contentions when we go be- <br />fore the United States Supreme Court. As Ed <br />Johnson said, we may stay out of the lawsuit <br />but we are not going to stay out of the de- <br />cisions. While the decisions will not be <br />binding on Upper Basin water users or on the <br />State of Colorado, they will establish pre- <br />cedent and I dare you to try to get the <br />Supreme Court to change its precedents once <br />established. <br /> <br />The first thing - well, no, I won't <br />say the first thing, there are so many <br />first things you can't say this must be <br />done first or that must be done first, but <br />this must be done and it's a monumental <br />task.~great big percentage of the testi- <br />mony which was presented in Arizona against <br />California before the Master will not speci- <br />fically effect us, but in order to find out <br />what will effect us, that entire transcript <br />must be reviewed and abstracted and the ex- <br />hibits which form a part of the testimony <br />must be scrutinized and studied. Now that's <br />at once an engineering job and a legal job. <br />It's a task which cannot be done in a few <br />days.
