<br />I <br /> <br />with same reasonable preservation of the natural environment, Colorado <br />Water Conservation Board is hereby vested with the authority on behalf <br />of the people of the State of Colorado, to appropriate in a manner <br />consistent with sections 5 and 6 of Article 16 of the State Constitution <br />to acquire such waters of natural streams and lakes as may be required <br />to preserve the natural environment to a reasonable degree. Prior to <br />the initiation of any such appropriation the Board shall request recom- <br />mendations from the Division of Wildlife and the Division of Parks and <br />Outdoor Recreation." <br /> <br />And it goes on to say, <br /> <br />"Nothing shall be construed as authorizing any state agency to acquire <br />water by eminent domain." <br /> <br />MR. FETCHER: Thank you. <br /> <br />MR. HANSON: Mr. Chairman, my name is Victor Hanson, and I'm the <br />president of the Water Conservancy Board in Jackson County. We have <br />discussed this thing at great length up in our count~. It's the feeling <br />of the people of the county that they don't think it s right. We've <br />tried to take a broad-minded view. of it. I've gone to the Forest <br />Service, and I've talked to organizations up there. We can see nothing <br />accomplished by this. Most of the lakes that are in Jackson County now, <br />two of them at the head of Big Creek Lake are already in a wilderness <br />area. The State Forest has jurisdiction over same of them. Lakes on <br />Chedsey and Newcomb Creek are in the study area a1read~, and they can <br />very well be added to this wilderness area. So we can t see where <br />anything can be accomplished by this. Fish and Game stocks these lakes <br />anyway and they're there for the public. Another thing that,we have <br />discussed was that these filings will cost the little guy who wants to <br />protest. He's going to have to hire himself a lawyer and he's going to <br />have ,to go to court, and it's going to cost him same money for something <br />he can't see any reason for. This is the consensus of what we have <br />found out in Jackson County. <br /> <br />MR. STAPLETON: Thank you, Mr. Hanson. Mr. Burr has consistently taken <br />that position, not only on these filings, but every other one. I'm <br />sure you've been well represented in that regard, although it's been a <br />minority of one in most cases. <br /> <br />MR. HANSON: I'm sure of that. <br /> <br />I <br /> <br />MR. KOCHMAN: I think one thing that might be <br />of the Forest Service. I am not aware of any <br />Service. If so, it would be the first time. <br />involved here. <br /> <br />pertinent is the attitude <br />opposition from the Forest <br />These are federal lands <br /> <br />MR. SPARKS: The Forest Service is actually charged with the same <br />responsibility.' The Forest Service is already making filings through- <br />out the state of Colorado for the same purpose.
