SPARKS: Again, let me point out that it cannot be impounded under <br />any circumstances to the detriment of downstream users. <br /> <br />MR. TRICK: A lot of people are not that comfortable about it as you <br />are. <br /> <br />I <br /> <br />. <br />MR. SPARKS: The law of this state for a hundred years has been that <br />senior water priorities must be filled first. I don't anticipate that <br />the law will. ever be changed in that respect. <br /> <br />. <br />MR. TRICK: May I ask a question? When this decree is issued, will it <br />go to the judicial court? <br /> <br />MR. SPARKS: It goes exactly through the same process as every other <br />requested decree. <br /> <br />. <br />MR. ,ROBBINS: These lists that are approved here are a request to the <br />Attorney General's office to make a legal filing in the water courts for <br />specified decrees. Many of the questions that you have raised are taken <br />care of in the application, because obviously are not in the format set <br />forth here. We do not intend to file at this time without refining the <br />present information. Generally, we're not attempting to file on beaver <br />dams unless they are associated with a natural lake. Nor do we intend <br />to file on levels that are artificially maintained by man-made struc- <br />tures. Occasionally there are natural lakes where people build dams, <br />and increase their capacity. I think that-it would be helpful if' <br />Mr. Kochman spoke briefly to the fact that all of the lakes that we" re <br />filin on have been visited by Wildlife crews at some time in the past <br />few years. I would like Mr. Kochman to explain the manner in which same <br />of the.facts set forth have been determined. ' <br /> <br />MR. KOCHMAN: My name is Eddie:Kochman, with the Colorado Division of, <br />Wildlife. We do owe the Jackson County commissioners an apology in <br />that we did file on a beaver lake last time. We made a mistake. As <br />Mr. Robbins said, it's not our intent to file on beaver dams. We're <br />trying to do the job on a state-wide basis ,and each one of these lakes <br />has been visited by a wildlife specialist, ,a gentleman by the name of <br />Don Gore. Don happens to be with the W. C. O. at Walden, and I wish he <br />were here talking instead of me. He knows these lakes and he probably <br />can justify each one. We're making the best effort we can. We did <br />not carry a transit up to some of these lakes. We did not spend weeks <br />trying to get down to the nth degree, but we.did.go to each lake. We <br />do have pretty good data and we're trying to do the best job we can. <br /> <br />MR.
