<br />MR. FISCHER: Mr. Chairman, I think the West Divide Board will under- <br />stand your position. The State Water Board has to be objective and,Eat <br />some ppd!ilt-;- has to make a decision. The West Divide is one of the five <br />projects authorized'in 1968. .The West Divide Board intends,to accom- <br />modate an environmentally reasonable West Divide project. The Colorado <br />River Water Conservation District's role in this matter is similar to <br />that of the State Water Board. We have not seen a reconnnended plan by <br />the West Divide Board. So the River District hasn't taken a stand in <br />spite of what the newspapers of Carbondale have said. <br /> <br />MR. STAPLETON: You must be fairly sensitive on this. <br /> <br />MR. FISCHER: The River District's role in this is that we intend to <br />figure out a way to protect the West Divide decree. I believe that <br />includes.the, Crystal River. There is a massive transmountain diversion <br />planned out of the headwaters of the Crystal River. We have been <br />accused that this is a thing that the River District has'made up. I <br />can assure you that the State Supreme Court is ready to set a trial date <br />on that issue. So the River District, and the West Divide, intends to <br />have an economically and environmentally sound project and we're in a <br />position -- I think the West Divide Board is in a position of determin- <br />ing its DPR -- of finding a plan that is economically and environ- <br />mentally sound and then the River District, at this point; must take.a <br />position. I agree with you, Mr. Chairman, it must have to develop in <br />the future. - <br /> <br />- . <br />MR. KROEGER: Mr. Chairman, up to this point,cIdidn't know who: those <br />cartoon.characters were. <br /> <br />MR. STAPLETON: Any further discussion? <br /> <br />MR. KOCHMAN: As I recall, the board discussed the Crystal quite some <br />time ago. There was a meeting in Durango that made it-pretty clear.' <br />The environment is an important consideration. The objective to main- <br />tain the stream, flow is hopefully still a ve:iworthwhile thing. Mr. <br />Fischer, and the Division of Wildlife -- that s one of the things we <br />asked for for further evaluation. In fact, we can solve this problem <br />of drying up of the lower Crystal River; <br /> <br />MR. SPARKS: That matter is in the capable hands of our Assistant <br />Attorney General. We are pursuing that matter as you know. <br /> <br />MR. STAPLETON: Is there any further discussion on the West Divide <br />only? <br /> <br />. <br />MR. FORD: Question. <br /> <br />MR.
