Discussion <br /> <br />The purpose of the POC is to ensure proper operation, maintenance and replacement <br />(OM&R) activities for the ALP. Initially, the POC will detennine the appropriate entity to <br />contract with the U.S. Bureau of Reclamation for the operation of the ALP. Long-term the POC <br />will determine the appropriate level of OM&R activities to ensure operational integrity and <br />public safety; this will include things such as OM&R funding and maintenance schedules. <br /> <br /> <br />During the development of the proposed Bylaws to date the following significant issues have <br />arisen. <br /> <br />. <br /> <br />1. The Animas-La Plata Water Conservancy District in Colorado and the San Juan Water <br />Commission in New Mexico have both expressed a strong interest in being the "Operating <br />Entity" that will contract with Reclamation to operate the ALP. The City of Durango and <br />Navajo Tribal Utility Authority have also expressed some interest but have not formally <br />asked to be considered. <br />2. There has been some discussion about the relationship between the Animas-La Plata Water <br />Conservancy District and the Colorado Water and Power Development Authority and <br />whether or not one or both agencies need to be represented on the POCo <br />3. Whether or not the first filling is a construction cost or an OM&R cost. To date it is being <br />considered as a construction cost. <br />4. Which parts of the Operating Criteria and Environmental Commitment Plan (ECP) are <br />OM&R costs? <br />5. Which entities are POC members, presently eight are proposed with six needing to be present <br />for a quorum. <br />6. Super majority voting on sensitive or critical issues. <br />7. Shortage provisions for both water supply and funding. <br />8. OM&R cost reimbursements. <br />9. Development of the ALP Operating Agreement. <br />10. Weeminuche Construction Authority has suggested the need for a permanent structure at the <br />Durango Pumping Plant to house the "Operating Entity." <br /> <br />The proposed Bylaws will remain in draft form until approved by all POC member agencies. <br />The next meeting will be July 17, 2002 in Durango. Staff needs to determine whether or not either <br />the State or the Board needs to be a member of the POC and, if so, who that representative should <br />be. <br /> <br />Recommendation <br /> <br />Staff does not have a final recommendation on this matter at present, but would like Board <br />input on the issue and approval to express our continued interest until a final decision is reached. <br /> <br />. <br /> <br />DRS <br />Attachment: <br />Proposed Bylaws <br /> <br /> <br />c:\mydocs\agendaALP2002.bdm.doc <br /> <br />Flood Protection.
