<br />'" <br /> <br />. <br /> <br />1, concern for potential conflicts between the <br />administration of the Act and the exercise of water <br />rights under state law and the allocations of water <br />made by interstate compact or jUdicial decree; <br /> <br />2. support for the on-going efforts to find administrative <br />solutions to these conflicts in the Upper Colorado <br />River and Platte River Basins; <br /> <br />3. support for seeking committee report language which <br />would recognize and confirm the appropriateness of <br />these efforts and would direct the Fish and Wildlife <br />Service to report back to Congress on the results; <br /> <br />4. support for limiting reauthorization of the Act to as <br />few years as possible; and <br /> <br />5. support for several substantive amendments to the Act. <br /> <br />Based on action taken by the Board at the March, 1985, <br />meeting. Mr. McDonald prepared written testimony for <br />presentation at the House and Senate subcommittee hearing. <br />Principal elements of the statement included: (1) a specific <br />request that reauthorization of the Act be for only two years, <br />and (2) no request for any substantive amendments to the Act. <br /> <br />4It FOllowing Board discussion, Mr. Smith moved, seconded by <br />Mr. Covert, that the Board (1) affirm for the record. the <br />written statement submitted by Mr. McDonald for the House and <br />Senate hearings, and (2) directed Mr. McDonald to actively <br />follow this legislation and to take such steps as he deems <br />necessary. in his discretion. to obtain the most favorable <br />legislation and committee reports for Colorado water users. <br /> <br />(A copy of the written statement is attached to Appendix <br /> <br />D. ) <br /> <br />Aqenda Item 10 - Division of Wildlife Threatened and Endanqered <br />Species Proqram (Appendix E) <br /> <br />Mr. McDonald prepared a memorandum for this agenda item <br />which was distributed to the Board in advance. Mr. McDonald <br />introduced Eddie Kochman, Chief of Fisheries Management for the <br />Division of Wildlife, to discuss this item. Mr. Kochman <br />provided a brief updated overview of the state's program. He <br />highlighted the statutory consultation process, which involves <br />water users among others, and noted that 160 notices were sent <br />out to various recent meetings; and that subsequently the <br />February 14, 1985, General provision Regulations were adopted. <br />He also noted that three fish were added to the threatened list <br />and one bird and five fish were removed. <br /> <br />. <br /> <br />-7- <br />
