<br />. <br /> <br />NOW THEREFORE, for and in consideration of the mutual <br />promises and agreements hereinafter expressed, it is hereby <br />agreed that: <br /> <br />1. The fOllowing definitions shall be utilized for the <br />purposes of this Agreement: <br /> <br />a. "South Platte Channelization proiect" ("Proiect"): <br />shall mean the Project authorized by the Flood Control <br />Act of May 17, 1950 (Pub.L. No. 516, 81st Congress, 2d <br />Sess. [1950]) which includes the improvements to the <br />flow of water in the channel of the South Platte River <br />which were constructed by the Corps upon lands owned by <br />the Grantor. Although this project was divided into <br />three reaches, only "Reach 2" (from Brown Ditch Weir to <br />Oxford Avenue) is covered by this easement. <br /> <br />. <br /> <br />b. "proiect Lands": shall mean all of the lands owned <br />by the Grantor within Reach 2 of the Project boundaries <br />from right of way line to right of way line. These <br />Project Lands are divided into three categories: Parks <br />Lands, Project Flood Conveyance Channel Lands, and <br />Project Recreation Lands. Only Project Recreation <br />Lands are covered by this Easement: <br /> <br />1). "proiect Flood Convevance Channel Lands:" <br />shall mean that portion of the strip of land that <br />is approximately three hundred (300) feet wide <br />along the channel of the South Platte River that <br />includes the channel of the river which conveys <br />the flow of the South Platte River through the <br />South Platte River Channelization Project <br />("Project") as illustrated on Exhibit A which is <br />attached hereto, and incorporated herein by <br />reference. These lands are located from the top <br />of the channel (slope) to top of the <br />channel (slope). <br /> <br />2). "proiect Recreation Lands:" shall mean that <br />portion of the strip of land that is approximately <br />three hundred (300) feet wide along the channel of <br />the South Platte River that is not included in the <br />"Project Flood Conveyance Channel Lands" as illus- <br />trated on Exhibit A. These lands are located on <br />either side of the "Project Flood conveyance <br />Lands." The width of these lands varies through- <br />out the Project. <br /> <br />. <br /> <br />3 <br />
