<br />. <br /> <br />. <br /> <br />. <br /> <br />EASEMENT REPORT #2 <br /> <br />South Platte River Channel Project <br /> <br />Stormwater Discharge, Littleton <br /> <br />Mr. Bill Wiggins owns a parcel of land immediately adjacent to the CWCB's east bank <br />easement of the South Platte River just south of Belleview Avenue in Littleton(see drawing). A <br />previous owner of an adjacent property in this area, Mr. Michael Stone, placed a drainage culvert <br />through the CWCB's east bank channel easement without permission in late 1990. The culvert <br />originates on the parcel of land formerly owned by Mr. Stone and now owned by a Mr, <br />Ackerman. <br /> <br />Through agreement with the U.S. Army Corps of Engineers, Omaha District, the CWCB <br />is required to provide internal drainage for the channel project. Mr. Wiggins and Mr. Ackerman <br />propose discharging historic stormwater flows from their properties through the culvert. They <br />would construct detention facilities on site so that flows above historic levels would be detained <br />on site until they could be released at historic rates. They also wish to install a flap gate on the <br />outlet end of the existing culvert to prevent South Platte River floodwaters from backing up <br />through the culvert onto their properties. This would require the removal of an existing flared <br />end section and the construction of a small headwall to mount the flap gate. All activities <br />associated with the culvert would occur on CWCB property. <br /> <br />Ouestions <br /> <br />How should they drain their property if the CWCB cannot grant them an easement? <br /> <br />How should the failure of the COE design to address such local drainage problems be resolved? <br />
