Water damage insurance for homeowners. <br />2 (1) EVERY INSURER ISSUING POLICIES OF HOMEOWNER'S INSURANCE, <br />3 EXCEPT THOSE INSURERS TIiATISSUE LESS THAN TWENTY - FIVE PERCENT OF <br />4 THEIR HOMEOWNER'S INSURANCE POLICIES TO INSUREDS WHO ARE <br />5 CONNECTED TO UTILITY SEWER OR WATER MAINS, SHALL OFFER AS A <br />6 HOMEOWNER'S INSURANCE POLICY RIDER WATER DAMAGE INSURANCE AS <br />7 DEFINED IN SUBSECTION (3) OF TIllS SECTION. <br />8 (2) NOTHING IN THIS SECTION SHALL BE CONSTRUED TO PROHIBIT <br />9 AN INSURER ISSUING POLICIES OF HOMEOWNER'S INSURANCE FROM: <br />10 (a) LIMITINGTHEAMOUNTOFCOVERAGEFORWATERDAMAGETO <br />11 A STATED AMOUNT NOT LESS THAN TEN THOUSAND DOLLARS; NOR <br />12 (b) ESTABLISHING APPROPRIATE UNDERWRlTING CRITERIA, <br />13 DEDUCTIBLES, AND POLICY LIMITS. <br />14 (3) As USED IN TIllS SECTION, "WATER DAMAGE INSURANCE" <br />15 MEANS INSURANCE AGAINST LOSS OF OR DAMAGE TO PROPERTY BY WATER <br />16 RESULTING FROM A BREAK IN, BLOCKAGE, OR LEAK FROM UTILITY OWNED <br />17 AND MAINTAINED CULVERTS, DRAINS, SEWERS, WATER MAINS, DITCHES, <br />18 CANALS, AND CESSPOOLS, INCLUDING WATER THAT BACKS UP THROUGH <br />19 SEWERS OR DRAINS. <br />20 SECTION 2. Effective date - applicability. (1) This act shall <br />21 take effect at 12:01 a.m. on the day following the expiration of the <br />22 ninety-day period after final adjournment of the general assembly that is <br />. 23 allowed for submitting a referendum petition pursuant to article V, <br />24 section I (3) of the state constitution; except that, if a referendum petition <br />25 is filed against this act or an item, section, or part of this act within such <br />26 period, then the act, item, section, or part, if approved by the people, shall <br /> <br />e <br /> <br />e <br /> <br />e <br /> <br />-2- <br />
