<br />J' <br /> <br />j <br /> <br />tit <br /> <br />tit <br /> <br />e <br /> <br />Second Regular Session <br /> <br />Sixty-second General Assembly <br />LLS NO. 00-0990.01 Pam Cybyske SENATE BILL 00-201 <br />STATE OF COLORADO <br />BY SENATOR Wham; <br />also REPRESENTATIVE Hoppe. <br /> <br />BUSINESS AFFAIRS & LABOR <br /> <br />A BILL FOR AN ACT <br /> <br />10 1 CONCERNING A REQUIREMENT FOR INSURERS TIiAT ISSUE HOMEOWNER'S <br />102 INSURANCE POLICIES TO OFFER WATER DAMAGE INSURANCE AS A <br /> <br />103 POLICY RIDER. <br /> <br />Bill Summary <br /> <br />(Note: This summary applies to this bill as introduced and does <br />not necessarily reflect any amendments that may be subsequently <br />adopted) <br /> <br />Requires insurers that issue policies of homeowner's insurance to <br />offer water damage insurance as a homeowner's insurance policy rider. <br />Exempts insurers that issue less than 25% of their homeowner's <br />insurance policies to insureds who are connected to utility sewer or water <br />mams. <br />Specifies that insurers are not prohibited from limiting the amount <br />of coverage for water damage to $10,000 nor from establishing <br />appropriate underwriting criteria, deductibles, and policy limits. <br />Defines "water damage insurance" as insurance against loss of or <br />damage to property by water resulting from a blockage, break in, or leak <br />from utility-owned and -maintained culverts, drains, sewers, water mains, <br />ditches, canals, and cesspools, including water that backs up through <br />sewers or drains. <br /> <br />1 <br />2 <br />3 <br />4 <br /> <br />Be it enacted by the General Assembly of the State of Colorado: <br />SECTION 1. Part 1 of article 4 of title 10, Colorado Revised <br />Statutes, is amended BY THE ADDITION OF A NEW SECTION to <br /> <br />read: <br /> <br />Capit4lletters indicate new materwl to be added to existing statute. <br />Dashes through the words indicate deletions from existing statute.. <br />
