Small Reclamation Proiect Loan Proqram - Appendix D <br /> <br />The Small Reclamation Project Act of 1956 authorizes the <br />Bureau of Reclamation to make long term. low interest loans and <br />some grants for small water projects. Because of its <br />importance as a funding source in Colorado and the other <br />Reclamation states. applications for loans now in the pipeline <br />exceed the current fund authorization. Increasing the <br />authorization by Congress is now necessary if additional loans <br />are to be made in the future. <br /> <br />Congressman Udall (Arizona) and others have introduced H.R. <br />2025 to increase the authorization for the program by $600 <br />million. Other provisions of the proposed bill pertain to <br />interest rates and non-federal cost-sharing. <br /> <br />. <br /> <br />Mr. Johnston moved. seconded by Mr. Getches. that the Board <br />support the enactment of H.R. 2025 and urge that hearings be <br />held on the bill. instruct Director McDonald to communicate the <br />Board's position to the state's Congressional delegation. to <br />Congressman Udall. to Assistant Secretary Broadbent (Interior). <br />and to others as appropriate. and delegate to Mr. McDonald the <br />preparation of testimony should hearings be held on the bill. <br /> <br />Motion adopted unanimously. <br /> <br />d. Federal Land Policy and Manaqement Act of 1976 (FLPMA) <br />- Appendix E <br /> <br />. <br /> <br />In summarIzIng this legislation. Mr. McDonald stated that <br />when ditch rights-of-way across federal land were established <br />in the late 1800's and early 1900's all that was required under <br />federal law was to build the ditch. Documentation evidencing <br />the right-of-way was not provided. With passage of the Federal <br />Land POlicy and Management Act of 1976 (FLPMA). the Forest <br />Service challenged the legality of these rights-of-way and <br />began requiring that they be converted into FLPMA permits. <br />Unless the holder agreed to take the permit and pay a fee. the <br />Forest Service threatened to terminate the right-of-way. In <br />addition. the Forest Service took the position that if a ditch <br />right was sold. the new owner of the water rights would have to <br />get a new FLPMA permit. <br /> <br />-7- <br />
