<br />MRR-25-2005 10:47 FROM:KEITH CRTLINN 9702494333 <br /> <br />TO: 13038664474 <br /> <br />P:2 <br /> <br />From the end of the irrigation season almost to the beginning of the next, all water in the <br />creek is diverted into the Hartman-McIntyre Ditch for stock watering under the right for <br />that purpose. <br /> <br />There is another ditch that takes water from the headwaters of the North Fork of Muddy <br />Creek in NE NE NW Sec. 2 SON 6W to fill Tyler Reservoir, an off-stream reservoir built <br />in 1954 and adjudicated in 1964 for 169.3 acre feet of storage. Muddy Creek as the <br />source of the water, and the existence of the ditch to transport it, were acknowledged by <br />Water Court in the Order creating the reservoir right. The reservoir and fill ditch have <br />been used continuously since, but apparently due to an oversight, the ditch is not listed on <br />current diversion lists. <br /> <br />e <br /> <br />Virtually no water is left in the lower reaches of Muddy Creek during the off-peak <br />months because the stock watering ditch dumps IlIIy surplus water into AIka1i Cree~ <br /> <br />A complete list of our adjudicated water rights and diversion records for the Hartman- <br />McIntyre and John Hoseman ditches are enclosed. <br /> <br />Thank you for your time, interest and cooperation, <br /> <br /> <br />t:: <br /> <br />e <br /> <br />. <br /> <br />. <br />
