This Committee asked for further' time to conduct <br />the study in which it was engaged. <br /> <br />At the July meeting a Committee on Legal Affairs to consider' a <br />number of legal questions affecting the compact was created. The <br />membership on the Committee consists of two men from each state. <br />Henry C. Vidal is chairman of the Committee. <br /> <br />I <br /> <br />Mr. Vidal then explained' Colonel.Hannis. District Engineer, Corps <br />~f Engineers. who has, charge of John Martin Reservoir. had advised the <br />governors of Colorado and Kansas' it would be necessary for the two states <br />to make a temporary agreement for the storage and release of water from the <br />reservoir for irrigation in the two states. This matter had been considered <br />by the Commission. He said that it was the view' of the Commission that it <br />had no authority. and believed that it was not advisable for the Commission. <br />to become responsibl~ for the making of suoh an agreement. Nevertheless <br />the Commission recommended to the governors of the two states that they <br />each appoint a representative on the Commission to advise the governors- in <br />the matter aIf an executive interim agreement. The Commission had <br />recommended the appointment of Harry B. Mendenhall for Colorado and W. E. <br />Leavitt for Kansas, These appointments were made. At the time of Mr. <br />Vidal's report no action had been taken by this special committee. <br /> <br />The Committee on Engineering Data had been very active, Mr. Vidal <br />reported. In the August meeting the Legal Affairs- Committee made a report. <br />Mr.. Vidal stated that the Commission would meet again at Topeka on <br />October 23 and 24, 1946. <br /> <br />Mr. C. L. Patterson, Chief Engineer of the Colorado Water Conservation <br />Board and a; member of the Arkansas Valley Compact Connnission for Colorado, <br />made a further report respecting the Arkansas Valley Compact Commission's <br />activities, covering other phases of t~e. compact negotiations. <br /> <br />Director Stone, Colorado Commissioner on the Upper Colorado River <br />Basin Compact Commission, submitted his report on the status of the Upper <br />Colorado River Compact negotiations. He read to the Board a letter, <br />addressed to Honorable John C. Vivian, Governor of the State of. Colorado, <br />which constituted a report on the matter and asked that the letter be made <br />a part of the reoord. The report is as follows: <br /> <br />"September 26, 1946 <br /> <br />"Honorable John C. Vivian' <br />Governor of the State of Colorado <br />State Capitol Building <br />Denver, Colorado <br /> <br />My dear Governor Vivian: <br /> <br />I <br /> <br />."In going over the minutes of the meeting of the <br />Colorado Water Conserva{ion Board, held July 21, 1946, I <br />find that the motion passed by the Board approving your <br />appointment of me as Colorado's Commissioner on the Upper <br />Colorado River Basin States Compact Commission, provided <br />that the Governor should be notified of such approval. <br />Of course, this should have been done irrespective of the <br />motion which was passed specifying such a notification. <br />For some reason I overlooked sending to you the notification. <br />
