<br />FINAL STAFF RECOMMENDATION ON SNOWMASS CREEK MODIFICATION <br /> <br />The biologic reports referenced in the staffs June 25,1996, memorandum to the Board <br />form the technical basis for the staffs final recommendation for modification on Snowrnass <br />Creek. Analysis of the best available data supports the Board's July 1992 decision to "conform" <br />its Snowrnass Creek instream flow water right to the Board's current instream flow standards. <br />Therefore, the staff recommends that the Board: <br /> <br />(I) Determine, pursuant to section 37-92-102(3), CRS, and based upon the <br />recommendation of the CDOW, a review of the data and other information <br />presented by the staff and others, in this memo and orally, that: <br /> <br />(a) A natural environment does exist on each stream segment; <br />(b) Water is available in each stream segment for appropriation; <br />(c) There is a natural environment that can be preserved to a reasonable <br />degree with the recommended water rights, if granted; <br />(d) The natural environment will be preserved to a reasonable degree by the , <br />water available for the recommended appropriations; and <br />(e) Such natural environment can be preserved without material injury to <br />water rights. <br /> <br />(2) ~ the Attorney General's Office to continue to pursue a decreed instream flow <br />water right in Case No. 92CW280 for an additional 3 cfs, from April I through <br />October 15, with a 1992 appropriation date on the reach ofSnowrnass Creek <br />between West Snowrnass Creek and Capitol Creek, thereby enlarging the Board's <br />existing 12 cfs instream flow right to 15 cfs during the summer period. <br /> <br />(3) Direct the Attorney General's Office to continue to pursue a decreed instream flow <br />water right in Case No. 92CW281 for an additionaIIO.5,'cfs, from April I through <br />October 15, with a 1992 appropriation date on the reach ofSnowrnass Creek <br />between Capitol Creek and the Roaring Fork River, thereby enlarging the Board's <br />existing 12 cfs instream flow right to 22.5 cfs during the summer period. <br /> <br />(4) Direct the CWCB staff and the Attorney General's Office to pursue a <br />modification, pursuant to the provisions of Senate Bill 96-64, of the CWCB's <br />Snowrnass Creek instream flow water right decreed in Case No. 76W2943 to 9 <br />cfs, from April 1 through October 15, and 4 cfs, from October 16 through March <br />31, on the reach of Snowrnass Creek between Snowrnass Lake and West <br />Snowrnass Creek. <br /> <br />(5) Direct the CWCB staff and the Attorney General's Office to pursue a <br />modification, pursuant to the provisions of Senate Bill 96-64, of the CWCB's <br />Snowrnass Creek instream flow water right decreed in Case No. 76W2943 to II <br />cfs from October 16 through March 31, on the reach of Snowrnass Creek between <br />Capitol Creek and the Roaring Fork River. <br />
