FINAL STAFF RECOMMENDATION ON SNOWMASS CREEK MODIFICATION

The biologic reports referenced in the staffs June 25,1996, memorandum to the Board
form the technical basis for the staffs final recommendation for modification on Snowrnass
Creek. Analysis of the best available data supports the Board's July 1992 decision to "conform"
its Snowrnass Creek instream flow water right to the Board's current instream flow standards.
Therefore, the staff recommends that the Board:

(I) Determine, pursuant to section 37-92-102(3), CRS, and based upon the
recommendation of the CDOW, a review of the data and other information
presented by the staff and others, in this memo and orally, that:

(a) A natural environment does exist on each stream segment;
(b) Water is available in each stream segment for appropriation;
(c) There is a natural environment that can be preserved to a reasonable
degree with the recommended water rights, if granted;
(d) The natural environment will be preserved to a reasonable degree by the ,
water available for the recommended appropriations; and
(e) Such natural environment can be preserved without material injury to
water rights.

(2) ~ the Attorney General's Office to continue to pursue a decreed instream flow
water right in Case No. 92CW280 for an additional 3 cfs, from April I through
October 15, with a 1992 appropriation date on the reach ofSnowrnass Creek
between West Snowrnass Creek and Capitol Creek, thereby enlarging the Board's
existing 12 cfs instream flow right to 15 cfs during the summer period.

(3) Direct the Attorney General's Office to continue to pursue a decreed instream flow
water right in Case No. 92CW281 for an additionaIIO.5,'cfs, from April I through
October 15, with a 1992 appropriation date on the reach ofSnowrnass Creek
between Capitol Creek and the Roaring Fork River, thereby enlarging the Board's
existing 12 cfs instream flow right to 22.5 cfs during the summer period.

(4) Direct the CWCB staff and the Attorney General's Office to pursue a
modification, pursuant to the provisions of Senate Bill 96-64, of the CWCB's
Snowrnass Creek instream flow water right decreed in Case No. 76W2943 to 9
cfs, from April 1 through October 15, and 4 cfs, from October 16 through March
31, on the reach of Snowrnass Creek between Snowrnass Lake and West
Snowrnass Creek.

(5) Direct the CWCB staff and the Attorney General's Office to pursue a
modification, pursuant to the provisions of Senate Bill 96-64, of the CWCB's
Snowrnass Creek instream flow water right decreed in Case No. 76W2943 to II
cfs from October 16 through March 31, on the reach of Snowrnass Creek between
Capitol Creek and the Roaring Fork River.
