ii. How aporopriation was initiated. The appropriation was initiated by
fonnation of the requisite intent to appropriate coupled with actions manifesting such an intent
sufficient to put third parties on notice, specifically the Longmont City Council's approval of the
St. Vrain Master Plan, East Corridor Update, on July 10, 200 I.

D. Amount and use. The following amounts (expressed in cubic feet per second)
are conditionally decreed herein for each of the structures collectively comprising the White Water
Course, for each of the specified time periods, for the specified recreational in-channel boating
use:
