Application. Longmont filed its Application for Water Right (the "Application") <br />on December 27, 2001. Longmont's Application is one contemplated by law. See &&37-82-101, <br />37-92-102(5),37-92-103(10.3),37-92-302,37-92-305,10 c.R.S. (2003). <br /> <br />3. Jurisdiction. Timely and adequate notice of the Application was given in the <br />manner required by law. See ~ 37-92-302, 10 C.R.S. (2003). This Court has jurisdiction over the <br />subject matter of these proceedings and over' all persons affected thereby, whether they have <br />appeared or not. None of the water rights or structures involved herein are located within a <br />designated groundwater basin. <br /> <br />4. Opposition. Statements of Opposition were filed by the Colorado Water . <br />Conservation Board, the State and Division Engineers, the Cache La Poudre Water Users <br />Association, the St. Vrain & Left Hand Water Conservancy District, the Colorado River Water <br />Conservation District, the Northern Colorado Water Conservancy District, and the Central <br />Colorado Water Conservancy District and Ground Water Management Subdistrict of the Central <br />Colorado Water Conservancy District. The time for filing additional Statements of Opposition has <br />expired. <br /> <br />5. Stipulations. Longmont entered into stipulations with <br />stipulations are approved and the terms of which are incorporated herein. <br /> <br />, which <br /> <br />6. CWCB recommendation. On January 16, 2002, pursuant to C.RS. & 37-92-102(5) <br />and 37-92-305(16), Longmont submitted a copy of the Application to the Colorado Water <br />Conservation Board ("CWCB "). The CWCB submitted its findings and recommendations to the <br />Water Court on <br /> <br />7. Name of structures. City ofLongmont White Water Course (also referred to herein <br />as the "White Water Course"). TIle White Water Course will be located in the proposed Dickens <br />Park, within the St. Vrain River Greenway, which is owned by the City of Longmont. The White <br />Water Course will consist of approximately five (5) individual physical control structures, each <br />designed to divert, capture, and control water between specific points, for the beneficial use of a <br />recreation experience in and on the water. The five structures aTe collectively referred to as the <br />City of Longmont White Water Course or White Water Course. . <br /> <br />A. Legal description of structures.
