This issue was identified in the Enviromnental Assessment as
follows:

Water rights of the Grand Valley washes: Reducing canal spills would decrease flows in
affected washes - Persigo, Big Salt, Little Salt and three tributaries to Salt Creek (Mack,
East Salt, Badger). Up to 155 water rights have been filed along the washes. Most of
these rights are conditional, and it is not known which rights actually depend on late
summer flows contributed by the canal spills. State water law encourages efficient use of
water, and there is no obligation to continue inefficient practices to supply water to other
water rights.

Individual water right holders have been encouraged to work with the Slate Engineer's
Office to resolve concerns. Options include the purchase of upstream reservoir water if
there is capacity in the canal; or requesting that the Grand Valley Water User's
Association to reclassifY their property to be eligible for canal water. This matter is being
addressed on a case-by-case basis.

Attachment

L:/boardmemlmarch 99121m Grand Valley Water Mgt.doc

3
