<br />. <br /> <br />" <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />March 29-30, 1999 Board Meeting <br />Agenda Item 21m <br />Page 3 of3 <br /> <br />WATER RIGHTS ON THE CANAL OUTFALL WASHES <br /> <br />Attached is an article (Attachment 1) concerning water rights along the six canal outfall <br />washes that would be impacted by reduced flows as a result of the Grand Valley Water <br />Management Project. This issue was identified in the Enviromnental Assessment as <br />follows: <br /> <br />Water rights of the Grand Valley washes: Reducing canal spills would decrease flows in <br />affected washes - Persigo, Big Salt, Little Salt and three tributaries to Salt Creek (Mack, <br />East Salt, Badger). Up to 155 water rights have been filed along the washes. Most of <br />these rights are conditional, and it is not known which rights actually depend on late <br />summer flows contributed by the canal spills. State water law encourages efficient use of <br />water, and there is no obligation to continue inefficient practices to supply water to other <br />water rights. <br /> <br />Individual water right holders have been encouraged to work with the Slate Engineer's <br />Office to resolve concerns. Options include the purchase of upstream reservoir water if <br />there is capacity in the canal; or requesting that the Grand Valley Water User's <br />Association to reclassifY their property to be eligible for canal water.
