<br />(4) Procedures. On the written req\lest of any person made within thirty days <br />after the date of the first public pleeting, the Board shall, within sixty days <br />after such request, establish fair: and fonnal procedures for the subsequent <br />public meeting, including th~ opportunity for reasonable disclosure, <br />discovery, subpoenas, direct eXlUpination, and cross examination. Subject to <br />these rights. and requirements, where a meeting will be expedited and the <br />interests of the participants will not be substantially prejudiced thereby, the <br />Board may choose to receive all or part of the evidence in written fonn. <br /> <br />(5) Final Detennination. The Board shall issue a final written detennination <br />regarding the modification that shall state its effective date, be mailed <br />promptly to the persons who appeared by written or oral comment at the <br />Board's proceeding, and be filed promptly with the water court. <br /> <br />10. ENFORCEMENT AGREEMENTS. The Board may attach conditions to an <br />appropriation, decreased appropriation, or acquisition, lmd may enter into any enforcement <br />agreements that. it detennines will preserve or improve the natural environment to a <br />reasonable degree. The Board may enter into eqforcemcmt agreements that limit the Board's <br />discretion in the protection, approval of inund~tion, modification or disposal of ISF right, <br />and/or may delegate limited authority to act on the Board's behalf. <br /> <br />lOa. Ratification of Enforcement Aareemehts. No enforcement agreement shall be <br />effective to limit the discretion of the Board until that agreement and all of its terms <br />are reviewed and ratified by the Board. Upon ra.tification, the Director may execute <br />the agreement and the agreement shall be binding upon the Board for the term. set <br />forth in the enforcement agreement. <br /> <br />lOb. Public Review Process. The Board shall ifollow the public review process set forth in <br />Rules lla. - llc. prior to any Board decision to ratifY an Enforcement Agreement. <br /> <br />11. PUBLIC REVIEW PROCESS. Except as otherwise provided in the ISF Rules, the Board <br />shall follow the Jlublic review process set forth 'below prior to any Board decision requiring <br />public review. . <br /> <br />Ila. Public Notice. Public notice of all 'Board actions under these Rules shall be. <br />provided through the agenda of each reg\llar or special Board meeting. <br /> <br />lIb. Public Comment. Except as otherwise ~rovided in Rules Sk. and 61., at a regnlar or <br />special meeting, the Board shall consid~r public comment on the recommended ISF <br />action prior to the Board action on the recommendation in any or all ofthe following <br />mamlers: <br /> <br />(I) Oral and/or written comments, may boe directed to Staff.
