<br />. <br /> <br />. <br /> <br />Cumulative Environmental Mitiqation Component <br /> <br />1. This component of the rate would be set at 1 mill per kwh <br />and would be in addition to the water project development <br />assistance component of the rate. It would be subject to <br />annual indexing and adjustment for degradation of the power <br />resource in the same manner as would the water project <br />development assistance component of the rate (see sections 1 <br />and 2.a. respectively. under the discussion of that rate <br />component). <br /> <br />2. Revenues from this component would be available for any and <br />all environmental mitigation of the CRSP. special studies. and <br />endangered species programs which are above and beyond section <br />8 mitigation as heretofore identified by Reclamation. <br />Congressional appropriations on a non-reimbursable basis per <br />the 1956 CRSP Act would continue to be the sole source of <br />funding for such mitigation. Revenues from this component <br />would be the source of funding for Reclamation's annual <br />contribution to the existing Upper Colorado River Basin <br />Endangered Fishes Recovery Implementation Program. <br /> <br />3. A decision-making mechanism for identifying the use of <br />these funds and handling their expenditure will have to be <br />agreed upon. <br /> <br />Security of the CRSP Power Resource for CREDA <br /> <br />1. Power contracts would have 40 year terms. <br /> <br />2. The contracts would provide that there would be no resource <br />reallocation to different customers during the 40 year term and <br />that there would be Congressional ratification of such terms as <br />were essential to the customers. <br /> <br />Security of Generation and Transmission <br /> <br />1. The states await the response of CREDA to the concepts <br />outlined by Reclamation and Western at earlier meetings. <br /> <br />Basis for Aqreements <br /> <br />1. The states understand that there will be no final <br />agreements until all aspects of the total package are in place <br />and committed to writing. <br /> <br />2. CREDA and the states will mutually support and defend all <br />elements of an agreement. Any modification by Congress of the <br />legislation required by an agreement that substantially affects <br />the interests of a party will be grounds for that party to void <br />the entire agreement. <br /> <br />-8- <br />
