9. Stream and Lake Protection - Amendment to Carbon Lake Ditch Donation Agreement

Action: A motion was made by Eric Wilkinson with a second by Ray Wright that the
Board approve the amendment to the Carbon Lakes Ditch Donation
Agreement to allow the acquired rights to be used to preserve or improve the
natural environment in the subject stream segments. Motion was approved 8-
O. Greg Walcher and Carolyn McIntosh were not present.

10. Stream and Lake Protection - Stream and Lake Protection - 2003 New Appropriation
Recommendations in Water Divisions 3, 5 and 6 (White River Basin).

Action: A motion was made by Ray Wright with a second by Keith Catlin to approve
the staff recommendation that the Board proceed as provided in Instream
Flow (ISF) Rule 5.21:
5.21 Board's Intent to Appropriate. Notice of the Board's potential action to
declare its intent to appropriate shall be given in the January Board meeting
agenda and the Board will take public comment regarding its intent to
appropriate at the January meeting.
5.21 (A) After reviewing Staff's ISF recommendations, the Board may declare
its intent to appropriate specific ISF water rights. At that time the Board shall
direct the Staff to publicly notice the Board's declaration of its intent to
appropriate.
5.21 (B) After the Board declares it's intent to appropriate, notice shall be
published in a mailing to the ISF Subscription Mailing List for the relevant
water division and shall state;
a. Description of Staff recommendations (e.g. stream reach, amounts, etc.);
