<br />7.1.2.3 The breach shall be designed to prevent silt previously deposited in the <br />reservoir and material excavated for the breach from washing downstream. <br /> <br />7.1.2.4 Water impounded in the reservoir area shall be released in a controlled <br />manner that will not endanger lives or damage downstream properties. <br /> <br />7.1.2.5 The drawing(s) of the plan for the breach ofa dam shall include the location, <br />dimensions and lowest elevation of the breach. <br /> <br />7.1.2.6 The removal or breaching of the dam shall be performed under the purview <br />of an engineer. <br /> <br />7.1.2.7 The engineer shall submit written notice of the completion of the removal or <br />breaching of the dam along with as-constructed plans in conformance with Rules 10. <br /> <br />7.1.3 Low Hazard and NPH Dams - For Low Hazard and NPH dams the owner shall <br />submit a written notice of intent to breach the dam to the State Engineer. The State Engineer <br />shall determine the size ofthe breach in accordance with the following: The bottom width <br />ofthe breach shall be one-half the height of the dam but not less than ten feet; and the side <br />slopes not steeper than one horizontal to one vertical. The breach shall be to original ground <br />at the low point in the foundation of the dam and the excavated material shall not be placed <br />in the stream channel. <br /> <br />Rule 8. Fees: <br /> <br />The owner shall submit with the application for construction, enlargement, alteration, modification, <br />or repair an amount equal to three dollars for each one thousand dollars or fraction thereof of the <br />estimated cost of construction including engineering costs, but the maximum fee shall not exceed <br />three thousand dollars, nor shall the minimum fee be less than one hundred dollars. When an owner <br />resubmits an application that was previously received and disapproved by the State Engineer, the <br />owner shall submit a new filing fee in accordance with the above. Checks shall be made payable to <br />the Colorado Division of Water Resources. <br /> <br />Rule 9. Construction of Jurisdictional Size Dams: <br /> <br />9.1. High Hazard and Significant Hazard Dams - For all High Hazard and Significant Hazard <br />dams, the owner shall provide an engineer experienced in dam design and construction, who shaH <br />be responsible for the following: <br /> <br />9.1.1 Plan for Construction Observation - Not less than 30 days prior to construction, the <br />engineer must submit to the State Engineer a general plan for construction observation. The <br />construction observation plan shall include: <br /> <br />9.1.1.1 The date ofthe start of construction; <br /> <br />29 <br />
