Williams (Pilgrim Downs <br />Subdivision), has filed a change of Water Right Application <br />in Eagle County, Colorado. The applicant is requesting to <br />move the present point of diversion on West Lake Creek <br />upstream. The Board has an instrea~ flow right for 5 cfs on <br />West Lake Creek. The staff was unable to determine from the <br />application the extent of injury, if any, to be caused by <br />the change in point of diversion. Since the potential for <br />injury existed, a Statement of Opposition was filed May 26, <br />1982. The Board has not yet ratified the Statement of <br />Opposition. <br /> <br />The applicants' attorney has provided additional <br />information to the staff since the filing of the Statement <br />of Opposition. This data indicates that no injury will <br />result to the Board's instream flow right on West Lake <br />Creek. <br /> <br />Staff Recommendations: Since there will be no injury the <br />Statement of Opposltlon need not be ratified.
