Walker <br />Deputy Director <br /> <br />FROM: Bill McDonald <br /> <br />DATE: July 22, 1982 <br /> <br />SUBJECT: Agenda Item 16 c, A.ugust 16, 1982, Board meeting <br />Case *4-82CW069, Crested Butte Mountain Resort <br />Ratify Entry of ApPearance <br /> <br />The applicant, Crested Butte Mountain Resort, has applied <br />for a conditional surface water right out of the East River for <br />snow making purposes at the Crested Butte Ski Resort in <br />Gunnison County, Colorado. A.pproxi~ately 5 cfs with an <br />appropriation date of March 25, 1981, would be diverted during <br />the snowmaking season for the expanded ski area. <br /> <br />At the the June 3, 1982 Board meeting, the Colorado Water <br />Conservation Board approved several final instream flow <br />recommendat ions for the East River. However, theSe <br />applications have not been filed in water court. The Board's <br />appropriation which could be affected by this application is <br />for S25, W15 cfs. Because the Board had not yet approved the <br />final instream flow recommendation when the May resume <br />referencing this application was published an Entry of <br />Appearance was filed instead of a Statement of Opposition. <br /> <br />The only objector in the case is the Division of <br />Wildlife. In a 1981 water right filing for snowrnaking <br />purposes, the Applicant agreed with the Division of wildlife <br />to leave 7 cfs in the stream before diverting 6 cfs for <br />snowrnaking. This was done "in order to mitigate any loss of <br />fish life in the East River caused by the Applicant's <br />diversions of water pursuant to the prior decree in Case <br />No. 81-CW69" as stated in the 1982 application.
