Case # 1-82CW083, City of Boulder,
Ratify Entry of Appearance

The applicant, the City of Boulder, seeks to make
absolute a conditional water right on Boulder Creek. The
City plans to use up to 50 cfs of the Public Service
Company's conditional direct flow right on Boulder Creek for
"general municipal and other benef icial purposes," to be
added to its existing municipal supply. The City apparently
intends to divert up to 50 cfs at the Public Service Company's
hydropower plant in Boulder Canyon.

The Colorado Water Conservation Board has an instream
flow decree for 15 cfs on Boulder Creek with an
appropriation date of October 1, 1973.

Staff Recommendation: Ratify the Entry of Appearance so
that the staff may be kept informed as to the status of this
case and may take appropriate steps to protect the Board's
instream flow right if it becomes necessary.
