CURRENT STATUS

After the filing of the water rights application with the
court, Trans-County Water Incorporated approached various funding
agencies inquiring as to what funds could be available for their
project. Those agencies, although they indicated approval of the
project, were rather reluctant to commit any money to Trans-
County until it became a statutory district with taxing powers.
But when Trans-County applied to the court in their attempt to
form a water conservancy district, the court denied the request
on the grounds that a detailed feasibility study for the project
had not been prepared.

In May, 1982, Trans-County Water Incorporated submitted an
application to the Colorado Water Conservation Board for funding
of a study of the proposed project. The staff has studied the
material submitted and has met with members of the entity and
with their attorney and engineers. The entity has not undertaken
any study of the proposed project since the court's denial of the
petition to form a water conservancy district.

.JWM:NCI:dm
attachments

-3-
